3G Proxy d.o.o. (“3G Proxy”, “we”, “our”, or “us”) is committed to protecting the privacy and personal data of its customers, users and business partners. This Privacy Notice explains how we collect, use, disclose, process and protect personal data in connection with the services provided by 3G Proxy and in accordance with applicable data protection laws, including the General Data Protection Regulation (EU) 2016/679 (“GDPR”), where applicable. 

3G Proxy d.o.o. is a company incorporated and operating in Montenegro. 

3G Proxy provides a mobile connectivity and testing platform enabling customers to perform legitimate testing, verification, quality assurance, fraud prevention, compliance verification and other lawful business activities using mobile network infrastructure, including mobile proxy access and optional SMS and USSD capabilities. 

By using our Services, you acknowledge that you have read and understood this Privacy Notice. 

 

2. Scope of this Privacy Notice 

This Privacy Notice applies to personal data processed by 3G Proxy in connection with: 

●​ Mobile Proxy Services; 

●​ SMS Services; 

●​ USSD Services; 

●​ API Services; 

●​ Customer support activities; 

●​ Account administration; 

●​ Billing and payment administration; 

●​ Website interactions; 

●​ Communications with customers and prospective customers. 

This Privacy Notice does not apply to third-party websites or services that may be linked from our website.

5. SMS and USSD Functionality 

Customers may utilize SMS and USSD functionality through the Services. 3G Proxy does not monitor, analyze or use the content of SMS or USSD communications for its own commercial purposes. Any processing of such communications is performed solely for the purpose of delivering the Services requested by the Customer. Customers remain solely responsible for ensuring that their use of SMS and USSD functionality complies with applicable laws, including obtaining any required legal bases, consents or authorizations.

 

6. Controller and Processor Roles 

3G Proxy primarily collects personal data directly from its customers. However, customers may choose to process third-party personal data through the Services. 

In such circumstances: 

●​ Customer acts as the Controller; 

●​ 3G Proxy acts as the Processor. 

Where 3G Proxy determines the purposes and means of processing its own operational data, 3G Proxy acts as an independent Controller. 

 

7. Purposes of Processing 

We process personal data for the following purposes: 

●​ providing and maintaining Services; 

●​ account administration; 

●​ customer support; 

●​ fraud prevention; 

●​ security monitoring; 

●​ legal and regulatory compliance; 

●​ invoicing and collections; 

●​ improving Services; 

●​ service-related communications; 

●​ responding to inquiries; 

●​ marketing communications where permitted by law. 

Users may opt out of non-essential marketing communications at any time.

10. Hosting Infrastructure and 

International Transfers 

3G Proxy operates from Montenegro and utilizes Amazon Web Services (“AWS”) infrastructure to host and support the Services. 

Customer data and related operational information may be processed and stored within AWS infrastructure located in Frankfurt, Germany. Germany is part of the European Economic Area (“EEA”). Where transfers of personal data outside Montenegro or the EEA become necessary, 3G Proxy shall implement appropriate safeguards required by applicable law. 

 

11. Data Retention 

Personal data shall be retained only for as long as necessary to fulfill the purposes described in this Privacy Notice. 

Retention periods may vary depending upon: 

●​ legal obligations; 

●​ operational requirements; 

●​ dispute resolution needs; 

●​ contractual obligations. 

Accounting and tax records may be retained for periods required by applicable law. 

Operational and security logs shall be retained only as reasonably necessary. 

 

12. Aggregated and Anonymized 

Information 3G Proxy may generate aggregated, statistical or anonymized information derived from Service usage. 

Such information:

●​ may be used for capacity planning; 

●​ may be used to improve the Services. 

Unless specifically required by law or necessary to provide the Services, we do not maintain records linking testing content to identifiable individuals.

3G Proxy implements appropriate technical and organizational measures designed to protect personal data against unauthorized access, disclosure, alteration and destruction.

Services hosted on AWS benefit from security measures implemented by AWS in addition to controls maintained by 3G Proxy. No method of transmission or storage can guarantee absolute security.

●​ request deletion; 

●​ request restriction of processing; 

●​ object to processing;

15. Children’s Privacy 

The Services are intended only for individuals aged eighteen (18) years or older. Individuals under eighteen (18) years of age may use the Services only where legally permitted and under the supervision and responsibility of a parent or legal guardian.

3G Proxy may update this Privacy Notice from time to time. Material changes shall be communicated through appropriate channels. The effective date above indicates the latest revision date.
